1. About Our Service
Soft Play In A Box Ltd provides children's entertainment packages for parties, celebrations and events.
Each booking is for a complete entertainment package and not solely for the use of individual items of equipment.
The package supplied by Soft Play In A Box Ltd may include:
· Booking administration and customer support.
· Selection and allocation of suitable soft play equipment.
· Equipment preparation.
· Nationwide delivery arrangements.
· Collection and return logistics.
· Cleaning and sanitisation of equipment.
· Inspection and maintenance of equipment.
· Health and safety guidance.
· Temporary use of the equipment during the agreed booking period.
The equipment supplied forms one element of the overall entertainment package provided by Soft Play In A Box Ltd.
The Company retains responsibility for the ongoing management, preparation, inspection, maintenance, cleaning and sanitisation of the equipment between bookings.
The Customer acknowledges that the booking fee relates to the overall entertainment package and associated services provided by Soft Play In A Box Ltd and not solely to the temporary use of the equipment.
2. Booking and Payment
Bookings are confirmed once the required deposit has been paid and confirmation has been issued by Soft Play In A Box Ltd.
The balance of the booking fee must be paid in accordance with the payment terms specified at the time of booking.
The Company reserves the right to cancel a booking where payment has not been received by the due date.
All prices include delivery and collection unless otherwise stated.
3. Delivery and Collection
Delivery and collection form part of the entertainment package provided by the Company.
The Customer must ensure that:
· Accurate delivery details are provided.
· Suitable access is available for delivery and collection.
· Someone is available to accept delivery.
· The equipment is available and ready for collection at the agreed time.
The Company cannot accept responsibility where delivery cannot be completed due to incorrect information, restricted access or the Customer's failure to accept delivery.
If collection cannot be completed due to the Customer's actions or omissions, additional charges may be incurred.
The Company reserves the right to charge additional costs arising from failed deliveries or collections.
4. Ownership of Equipment
All soft play equipment, accessories, mats, ball pits, play items and any other equipment supplied by Soft Play In A Box Ltd remain the sole property of the Company at all times.
The Customer acquires no ownership, proprietary or other legal interest in any equipment supplied by the Company.
The Customer is granted only a temporary and non-transferable right to use the equipment for the specific event and booking period agreed with the Company.
The Customer must not:
· Sell, lend, assign or sub-hire the equipment.
· Allow the equipment to be used for any commercial purpose without the Company's written consent.
· Remove safety labels, warnings or identification markings.
· Alter, modify or repair the equipment.
· Retain possession of the equipment beyond the agreed booking period without prior written consent.
At the end of the booking period, the equipment must be made available for collection and returned to the Company's control.
5. Customer Responsibilities
The Customer accepts responsibility for the equipment whilst it is in their custody during the booking period.
The Customer must take reasonable care of the equipment at all times.
The Customer is responsible for any loss, theft or damage occurring whilst the equipment is under their control, except where caused by a defect in the equipment or the negligence of the Company.
The Customer must immediately notify the Company if any equipment becomes damaged, unsafe or unavailable for collection.
The Customer must ensure that equipment is not used in a manner that could reasonably cause damage, injury or excessive wear.
6. Use of Equipment
The equipment must only be used for its intended purpose.
The Customer must ensure that:
· Appropriate adult supervision is maintained at all times.
· Users remove footwear before using the equipment.
· Food and drink are not consumed on the equipment.
· Glass items are kept away from the equipment.
· The equipment is used in a safe and responsible manner.
The Company reserves the right to recover the cost of cleaning, repair or replacement resulting from misuse of the equipment.
7. Outdoor Use
The equipment may be used outdoors provided suitable weather conditions exist.
The Customer must ensure that the equipment is protected from:
· Rain.
· Excessive moisture.
· Mud.
· Standing water.
· Animal fouling.
· Any condition likely to cause damage.
Equipment that is exposed to unsuitable conditions may give rise to cleaning, repair or replacement charges.
The Company reserves the right to advise that equipment should not be used outdoors if weather conditions present a risk to safety or the equipment.
8. Cleaning and Condition of Equipment
The Company prepares, inspects and sanitises equipment before each booking.
The Customer must return the equipment in substantially the same condition as it was delivered, allowing for reasonable use during the event.
Where equipment is returned excessively dirty, additional cleaning charges may apply.
Where equipment has been damaged, repair or replacement costs may be charged to the Customer.
9. Health and Safety
The Customer is responsible for ensuring that:
· Equipment is used only by appropriate age groups.
· Adequate adult supervision is maintained.
· Users comply with any safety instructions provided.
· Unsafe behaviour is prevented where reasonably possible.
The Customer must stop the use of equipment immediately if it becomes unsafe or damaged.
The Company may provide guidance regarding safe operation of the equipment, but responsibility for supervision during the event remains with the Customer.
10. Equipment Substitution
The Company reserves the right to substitute equipment with equivalent or higher-value alternatives where necessary because of:
· Maintenance requirements.
· Safety concerns.
· Operational requirements.
· Circumstances outside the Company's reasonable control.
Any substitute equipment will be selected to provide a comparable experience wherever reasonably practicable.
11. Cancellation and Changes
Cancellation requests must be made in writing.
Deposits are non-refundable unless otherwise agreed by the Company.
Where the Company agrees to transfer a booking to an alternative date, this will be subject to availability.
The Company reserves the right to cancel or amend bookings where circumstances occur that are beyond its reasonable control.
12. Liability
Nothing in these Terms and Conditions excludes or limits the Company's liability for:
· Death or personal injury caused by its negligence.
· Fraud or fraudulent misrepresentation.
· Any liability that cannot legally be excluded or limited.
Subject to the above, the Company's liability arising from any booking shall be limited to the amount paid by the Customer for the relevant booking.
The Company shall not be responsible for losses arising from circumstances beyond its reasonable control.
13. General
These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the booking.
If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect.
These Terms and Conditions shall be governed by the laws of England and Wales.
